Terms of Service

In short: Moonpane is a free visual web app, provided as it is. Use it for fun and for yourself. Donations are optional gifts and unlock nothing. We are not Apple, Google, Samsung or Mozilla, and any changes you make to your phone are your own.

Agreement

These terms are an agreement between you and us. By tapping Enter the city, or by using Moonpane at moonpane.pages.dev (the "Service"), you agree to them and to the Privacy Policy. If you do not agree, please do not use it.

What Moonpane is

Moonpane, previously called Nightglass, is a free web app for a general audience. In these terms, "we" and "us" mean the Moonpane project. It shows animated city scenes, draws wallpapers, widget panels and icon art on your device, and offers guides for using them on your phone. If you are under 13, please use it with a parent or guardian.

Not affiliated with Apple, Google or others

iPhone, iOS, Safari and Home Screen are trademarks of Apple Inc. Android, Chrome and Pixel are trademarks of Google LLC. Samsung is a trademark of Samsung Electronics Co., Ltd. Firefox is a trademark of the Mozilla Foundation. Cloudflare is a trademark of Cloudflare, Inc. Other product names belong to their owners. We are not affiliated with, endorsed by or sponsored by any of these companies. The guides describe features of your device, but menus change between versions and phone makers. Follow them at your own risk: you make any changes to your phone yourself.

Using the Service

Use Moonpane lawfully and for yourself. You must not attack or overload it, scrape it at scale, probe it for weaknesses, or use it to break the law or harm others. We may block access that looks abusive.

Art you create

You may use the wallpapers, widget panels and icon art you create with Moonpane for personal, non-commercial purposes, and share them with friends or on social media. You must not sell them, resell the app, or copy the app's code, design or branding and present it as your own.

Ownership

Moonpane, including its code, design, original artwork and branding, belongs to its creator. Your device and anything you save to it belong to you.

Donations

• If the app shows a donation link, donating is voluntary. A donation is a gift to support the project.
• You get nothing in return: nothing in Moonpane is locked behind a donation, and a donation gives you no ownership, membership or other rights.
• Payments are handled by a separate payment provider under its own terms. We never see your card or bank details.
• Donations are non-refundable unless the law or the provider's rules say otherwise.
• Moonpane is a personal project, not a charity, so donations are not tax-deductible.
• You must be old enough to make a payment where you live, or have a parent or guardian's permission.
• We may change or remove the donation option at any time.

Availability and changes

Moonpane is free and may change, break or end at any time without notice. Offline mode keeps copies of the app's files on your device, and updates arrive when you are online.

No warranty

Moonpane is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent the law allows, we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that it will work on every device, browser or system version, or that it will be uninterrupted or error free.

Limits on our liability

To the fullest extent the law allows:

• We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost data, profits or device settings, arising from your use of Moonpane or from not being able to use it.
• Our total liability for any claim about Moonpane or these terms is limited to US$50.
• These limits apply even if the loss was caused by our own negligence, and even if we were told it could happen.

Nothing in these terms limits liability for gross negligence, willful misconduct or fraud, any other liability that cannot be limited by law, or any consumer rights you cannot waive.

Ending use

You can stop using Moonpane at any time. We may suspend access if these terms are broken or the Service is being abused.

Problems and disagreements

If something goes wrong, or you disagree with something we have done, please write to us first at moonpane.support@gmail.com. Most problems can be sorted out that way. This does not take away any right you have to contact a consumer body or go to court.

Copyright complaints

If you believe something in Moonpane copies your work, send a notice to moonpane.support@gmail.com that includes:

• your physical or electronic signature
• the work you say was copied
• where the material appears in Moonpane, with enough detail for us to find it
• how to reach you
• a statement that you believe in good faith the use is not authorized
• a statement, under penalty of perjury, that your notice is accurate and that you own the rights or may act for the owner

We will look into complete notices promptly.

Changes to these terms

We may update these terms and will change the date above when we do. If a change is significant, we will also say so in the app. Using Moonpane after a change means you accept the new terms.

Governing law and courts

These terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law rules, except where your local consumer law says otherwise. Where the law allows, any dispute about these terms or Moonpane must be brought in the state or federal courts located in Indiana, and you agree to those courts' jurisdiction. This does not remove any right your local consumer law gives you to bring a claim where you live.

General

If any part of these terms cannot be enforced, the rest stay in force. These terms and the Privacy Policy are the whole agreement between you and us about Moonpane. If we do not enforce a right, we have not given it up.
